The Supreme Court has ruled in favour of Oyo State Governor, Seyi Makinde, against the decision of the Court of Appeal.
KanyiDaily had reported that the Appeal Court upheld an appeal filed by the governorship candidate of the All Progressives Congress (APC), Adebayo Adelabu, to sack Seyi Makinde of the People’s Democratic Party (PDP) as Oyo state governor.
The appeal court in a majority decision said Oyo State Governorship Election Tribunal was wrong to have dismissed the petition of Adelabu.
The court, however, refused to sack Mr Makinde as Oyo governor because the 180 days given for election case to be heard had been exhausted.
A minority member of the appeal court however ruled in favour of Mr Seyi Makinde.
In a unanimous judgment on Wednesday, December 18, 2019, the Supreme Court found merit in the appeal filed by Mr.Makinde that the majority judgment of the Appeal Court was a miscarriage of justice.
The court, therefore, affirmed the majority judgment of the trial tribunal which upheld the election of Makinde as the duly elected governor of Oyo State.
The judgment applies to the remaining three appeals emanating from the election.
