Nnamdi Kanu’s Motion For Urgent Medical Care Sent Back To Chief Judge

Justice Musa Liman of the Federal High Court in Abuja has returned Nnamdi Kanu’s motion for medical transfer to the Chief Judge for reassignment.

Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), had filed the motion seeking a court order to transfer him to the National Hospital, Abuja, for urgent medical care.

In a brief ruling, Justice Liman stated that the case should be returned to the Chief Judge following an application by Kanu’s lawyer, Uchenna Njoku, SAN, emphasizing that the court’s annual vacation ends today, September 15.

Counsel for the Department of State Services (DSS), Adegboyega Awomolo, SAN, did not oppose the request.

Earlier in the resumed hearing, the judge explained that the vacation court did not have enough time to consider Kanu’s motion.

The registrar had listed over 30 cases for the day, but only six were scheduled to be heard.

Justice Liman added that, under Section 46(8) of the Federal High Court Rules, any case that cannot be completed during the vacation must be sent back to the Chief Judge for reassignment.

He also noted that while Kanu’s motion was urgent due to his health, it was filed too late to be addressed immediately.

Awomolo agreed, saying the court decides which cases can proceed during vacation.

“Had it been that they filed the application earlier, it would have been taken during vacation. But we are ready to take the motion any time, any day,” he added.

The judge then directed that the case file be sent to the court registry for reassignment.

KanyiDaily recalls that the High Court in Nairobi, Kenya, previously ruled that the abduction and extradition of Nnamdi Kanu from Kenya to Nigeria in June 2021 was illegal and a violation of his rights.
