Nasir El-Rufai is expected to appear before Justice Joyce Abdulmalik at the Federal High Court in Abuja.
On February 18, the DSS briefly detained El-Rufai after he had already spent two nights with the Economic and Financial Crimes Commission (EFCC).
During a recent appearance on Prime Time, a programme on Arise Television, el-Rufai claimed that someone had tapped the phone of National Security Adviser Nuhu Ribadu.
According to him, this allowed him to hear Ribadu instructing security officials to arrest him.
Following that interview, the DSS filed a three-count charge against the former governor on Monday.
The agency accused him of unlawfully intercepting the NSA’s phone conversation, an action it said violates the Cybercrimes (Prohibition, Prevention, etc.) Amendment Act, 2024, as well as the Nigerian Communications Act, 2003.
