A five-member panel of the apex court on Friday dismissed the appeal filed by Gbadebo Rhodes-Vivour and Abdulazeez Adediran.
Rhodes-Vivour, the Labour Party (LP) governorship candidate, had contended that Deputy Governor Obafemi Hamzat was not qualified due to alleged renunciation of Nigerian citizenship for that of the US.
The court ruled that there was insufficient evidence supporting the claim and emphasized that citizenship by birth cannot be stripped, even if a person voluntarily takes up the citizenship of another country.
The court required evidence, such as a renunciation register, which was not provided, deeming the appeal an abuse of court process.
Similarly, the court rejected the appeal by Abdulazeez Adediran (Jandor), the Peoples Democratic Party (PDP) governorship candidate, stating that the matter was a pre-election issue inappropriate for tribunal consideration.
