El-Rufai is demanding ₦1 billion in damages from the Independent Corrupt Practices and Other Related Offences Commission (ICPC), the Chief Magistrate Court of the Federal Capital Territory in Abuja, the police chief, and the Attorney-General of the Federation.
The former governor filed the case to challenge a search conducted by security agents at his residence in the Asokoro area of Abuja.
During the operation, officers reportedly recovered some items from the house.
In response to the suit, the police chief filed a counter-affidavit defending the action.
He accused El-Rufai of trying to use the court case to avoid investigation and possible criminal charges.
According to the IGP, the police are legally empowered to detect crimes, arrest suspects, investigate cases, and prosecute offenders.
He maintained that the search of the residence was carried out based on a valid warrant issued by a competent court.
The police chief also dismissed El-Rufai’s claim that the warrant used for the search was unlawful, insisting that it was properly granted and executed in line with legal procedures.
When the matter came up in court on Thursday, El-Rufai’s lawyer, Ubong Akpan, informed the judge that he had not yet filed a response to the IGP’s counter-affidavit, though he had already replied to the submission made by the ICPC.
Lawyers representing the ICPC and the IGP — Abdulsufianu Abubakar and Ezekiel Rimamsomte — did not object when Justice Joyce Abdulmalik postponed the case.
The court then adjourned the matter until March 25 for hearing.
The judge also directed that hearing notices be issued to the second respondent, a Chief Magistrate of the FCT, and the fourth respondent, the Attorney-General of the Federation, since neither party had a representative in court during the session.
