The Ibadan Division of the Court of Appeal, Oyo State, has nullified the N20 billion damages awarded to Yoruba Nation agitator, Sunday Adeyemo, popularly known as Sunday Igboho, against the Department of State Security (DSS).
KanyiDaily recalls that in July 2021, DSS operatives invaded Igboho’s home in Ibadan, leading to the arrest of 12 of his aides, while the Yoruba nation agitator managed to escape arrest.
Following the raid, Igboho sued the Federal Government and demanded damages sum of ₦500 million as special damages for the damage done to his house and his car.
Igboho also asked the court to order the respondents to pay him another ₦500 billion as exemplary and aggravated damages for beaching his fundamental rights with the malicious invasion of his house.
September 2021, Oyo State High Court declared the raid conducted on Igboho’s residence by the DSS operative as illegal.
Justice Ladiran Akintola described DSS’ action as “arbitrary aggression and prejudices” against Igboho, ordering DSS to pay N20 billion to Igboho as exemplary and aggravated damages.
However, in another judgment on Tuesday, August 30, Justice Muslim Hassan set aside the judgment that declared the attack on Igboho’s house illegal, describing the award for damages against the DSS as outrageous.
Justice Hassan stated that the Oyo State High Court ignored the grounds for the case in acquiring jurisdiction and that the judge should not have decided on the award of damages based on his own preferences.
